The definition of a weapon provided by the Florida Statute  says “any dirk, knife, metallic knuckles, slingshot, billie, tear gas gun, chemical weapon or device, or other deadly weapon except a firearm.”

Even though that the right to bear arms is guaranteed by the Second Amendment, the state of Florida has passed laws regulating the possession of them. It is criminalized to purchase, possession, or use of weapons or firearms and the violation of any of these laws usually carries harsh penalties that could include jail time, fines, forfeiture and limitations on possession of weapons in the future.

There are also two sets of laws regarding weapons: those set by the federal government and those by the state of Florida.

WEAPON OFFENSE & ENHANCEMENT:

 

  • A weapon offense is based exclusively on the fact that an individual improperly possessed, purchased or used a weapon.
  • A weapon enhancement increases the penalties of a crime; or requires a mandatory minimum prison sentence when used in the commission of a violent crime such as aggravated assault or aggravated robbery. The most common weapon enhancement charge is from 10 to 25 years in prison.

UNLAWFUL POSSESSION OF A FIREARM

If you don’t follow the specific requirements for purchasing a weapon you could be charged with illegal possession of a firearm. The penalty goes from a misdemeanor to a felony conviction. If the person has no license, it is a 3rd degree felony punishable by fines up to $5000 or 5 years of probation or jail sentence.

Moreover, a person who has been convicted of any previous felony shall not carry a firearm in the state of Florida. It is considered as one of the most serious gun offenses and is punishable by fines up to $10000 and up to 15 years of probation or jail sentence.

ILLEGAL SALE OF A WEAPON

Gun sellers are mandated to abide by very specific procedures when selling weapons by Florida gun laws. Failure to adhere to these laws can result in the losing of the element as well as the selling license.

You could face felony criminal charges If you illegally sell a weapon or firearm as an unlicensed dealer. The sentence will depend on the magnitude of weapons sold, and the way the unlicensed dealer obtained the weapons.

UNLAWFUL DISCHARGE OF A WEAPON

When a weapon or firearm is discharged in a public location the person who discharged it could be convicted of a 1st degree or if the offender has an established criminal record, a more serious felony criminal weapons charges if the offender has an established criminal record a more serious penalty will follow. If a weapon is unlawfully discharged from a vehicle within 1,000 feet of any person, the offender will be charged with a 2nd-degree felony.

POSSESSION OR DISCHARMENT OF A WEAPON AT A SCHOOL 

The individual could be charged if caught carrying a firearm in a rude, carelles or hazardous way; in the presence of at least 1 person, at a school sponsored event, or on the premises of a school.

This crime is considered as a 3rd degree felony punishable by 5 years of probation or jail and fines up to $5000.

ALLOWING A MINOR TO ACCESS A LOADED FIREARM

Allowing a person under the age of sixteen years old to access a loaded weapon or firearm is considered a second-degree misdemeanor punishable by fines up to $500 and up to 60 days in jail.
