In the state of Florida, drug possession has been described as holding a substance for personal use. The individual who possess the drug is not the one who had manufactured, distributed or sold it.

The Florida law recognizes two types of drug possession:

 1. Actual possession of an illegal substance:

It occurs when the controlled substance is in the physical custody of the person and it is discovered in his hands, jacket, bags, pocket of trousers, etc.

  1. Constructive possession:

 It occurs when a person does not have the possession but has knowledge about the location of the substance and is able to access or regulate it

The penalties of both crimes will depend basically on the type and amount of substance.

In addition, if the arrest takes place in a particular area such as near a school or daycare harsher punishments like jail time may apply.


It is described as any object or item used for the consumption, production, or processing of a controlled substance. It is considered as a first-degree misdemeanor punished by up to 1-year prison time or probation, and fines up $1,000.

The Florida Statutes classifies the drugs in five different groups:

Schedule I: Drugs with strong potential for abuse and no clinical use permitted

Schedule II: Strong potential for abuse but with limitations is also a permitted clinical use.

Schedule III: Abusing medicines but less than the possibility of the drugs found in Schedules I and II, and medical use is still permitted.

Schedule IV: The drugs integrated with an authorized clinical use have a significantly decreased abuse capacity-but not abuse chance.

Schedule V: Low potential for abuse relative to the substances and medicines that contain very small amounts of specified narcotic drugs.


  • It is considered as a Third Degree Felony if the possession is of 20 or more grams of marijuana or up to 28 grams of cocaine, 10 grams of ecstasy (MDMA), 1 gram of LSD and 4 grams of heroin/opiate.

Whether convicted the sentence may include up to 5 years in prison.

  • It is considered a Second-Degree Felony if the possession is of chemicals used to manufacture drugs such as ecstasy, acid and meth.

Whether convicted the sentence may include up to 15 years in prison, and $10,000 fines.

  • It is considered as a First-Degree Felony if the possession is of more than 25 lbs marijuana, 28 grams of cocaine, 10 grams of ecstasy and 4 grams of heroin / opiates.

Whether convicted the sentence may include up to 30 years in prison, and $250,000 in fines.
